Client Declaration
This Client Declaration (“Declaration”) is made by the undersigned applicant (“Client”) in favor of Ebal Financial Corp., operating under Emerserve.com (the “Company”).
1. Representation and Warranties
The Client hereby represents, warrants, and agrees to the following:
The Client shall not submit, upload, or otherwise provide to the Company any illicit, obscene, or pornographic imagery.
The Client shall provide the Company with valid and verifiable government-issued identification upon request.
If the Client is under the age of 18, a parent or legal guardian must apply and execute this Declaration on behalf of the minor.
2. Terms of Service
If the Client has engaged Emerserver.com for rendering professional services, the Client agrees to remit the required Deposit ("the Deposit") in advance of the delivery date. All Deposits shall be held in trust by Ebal Financial Corp. and disbursed at the sole discretion of the Company, in accordance with approved budgets or directives provided by the Client.
All transmitted documents to the Company are subject to review and confirmation by the Company’s underwriting and risk or dispatch team.
Upon the completion of the order, the Company will provide the Client with a Final Invoice (the "Final Invoice") for any costs greater than the Deposit. All Invoices are due and payable in full upon receipt.
3. Delivery Authorization
The Client hereby authorizes the Company to act as a proxy for in-person document deliveries using the Client's name, image, likeness, and related promotional materials for the purposes of rendering specific services on behalf of the Client.
4. Fees for Services
The Client acknowledges and agrees to the following service fees payable to the Company:
Base Rate: $18.00 per attempt at service, in addition to the Standard Service and
Rush Service Requests submitted on www.emerserve.com
Standard Service: $75 includes up to 2 attempts at service, in addition to any Mileage Surcharges, 20 Free KM, and Photocopying Service 10 Free Pages
3 Hour Rush: $175.00 per request, in addition to the Base Rate
Same Day ( 3 PM): $150.00 per request, in addition to the Base Rate
Same Day (7 PM): $125.00 per request, in addition to the Base Rate
Next Day Services (10 AM): $100.00 per request, in addition to the Base Rate
Next Day (3 PM): $100.00 per request, in addition to the Base Rate
Next Day (7 PM): $75.00 per request, in addition to the Base Rate
Mileage Surcharge: $0.75 per kilometer- based on a round trip from the nearest Ebal Financial Corp. satellite office or branch
Black and White Photocopying Service: $0.72 per page, includes 10 free pages per order
Full Colour Photocopying Service: $0.79 per page. includes 10 free pages per order
Sworn Affidavits: $48.00 per request, in addition to the Standard Rate, Photocopies, Mileage Surcharges, and Rush Services
Address Verification Service (Skip Tracing): $385.00 per subject or person of interest.
The Client understands that all fees are non-refundable and subject to applicable taxes.
5. General Provisions
The Client understands that participation in any service offered by the Company is conditional upon compliance with the terms set forth in this Declaration.
The Company reserves the right to withdraw, suspend, or decline services if the Client is found to be in breach of this Declaration.
6. Acknowledgement:
By selecting the "I agree" checkbox on www.emerserve.com, the Client (or the Client's parent/legal guardian if under 18) acknowledges that they have read, understood, and agreed to the terms of this Declaration.
